Waiver and Release of Liability
I am volunteering for the Eno River Association and acknowledge that performing work and being in the outdoors involve various risks. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, weather, lack of hydration, other participants, equipment, vehicular traffic and actions of others.
I take on these risks of my own free will and will exercise my own judgment to keep my activities within my own abilities, to safeguard my health and safety, and to seek help when needed. I certify that I have no health-related reasons or problems which prelude my participation in this activity. I am over the age of 18.
I understand the risks incurred may result in injury, even grave injury or death. For myself, my heirs, assigns or personal representatives, I knowingly and voluntarily enter into this waiver and release of liability, and hereby waive any and all rights, claims or causes of action of any kind arising out of my participation. I release and forever discharge from such liability the Eno River Association / Festival for the Eno, their affiliates, managers, members, agents, and volunteers, including their heirs, representatives, successors, and assigns.
Should I require medical care treatment, I agree to be financially responsible for costs incurred for such treatment. I understand I should carry my own health insurance.
In the event that any damage to equipment or facilities occurs as a result of my willful actions, neglect or recklessness, I agree to be held liable for the costs of repairing or replacing the property damaged. Whether or how to repair or replace the damaged property is at the sole discretion of the property owner.
While participating in this activity, I may be photographed. I agree to allow my photo, video or film likeness to be used by the Eno Association and its assigns to promote the Festival for the Eno, the Association and its activities and purposes.
I CERTIFY THAT I HAVE READ THIS DOCUMENT. I UNDERSTAND ITS CONTENT, THAT THIS RELEASE CANNOT BE MODIFIED ORALLY, AND THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT TO WAIVE ANY RIGHTS I NOW HAVE OR MAY HAVE IN THE FUTURE TO BRING LEGAL ACTION FOR PERSONAL INJURY OR PROPERTY DAMAGE. I SIGN IT OF MY OWN FREE WILL.
